DOT secures consumer protections ahead of Alaska-Hawaiian Airlines merger

As the proposed merger of Alaska and Hawaiian Airlines moves forward, the Department of Transportation is requiring new enforceable consumer protection guarantees from both airlines.

“Our top priority is protecting the traveling public’s interest in this merger. We have secured binding protections that maintain critical flight services for communities, ensure smaller airlines can access the Honolulu hub airport, lower costs for families and service members, and preserve the value of rewards miles against devaluation,” Transportation Secretary Pete Buttigieg said in a statement. “This more proactive approach to merger review marks a new chapter of DOT’s work to stand up for passengers and promote a fairer aviation sector in America.”

According to the DOT, the airlines promised that once combined they will adhere to the following commitments among others:

  • Maintain the value of airline miles in a new combined frequent flyer program
  • Continue serving inter-island and continental routes in the Hawaii market
  • Preserve Essential Air Service routes in both Alaska and Hawaii
  • Foster competition at the new combined airline's Honolulu hub
  • Guarantee free family seating 

The DOT said it has granted an exemption to the airlines to start merging their businesses, but final approval for a full combination of their operations is pending further review.

During a press briefing about the consumer protections Tuesday, DOT officials noted that the Department of Justice has not moved to block the merger on antitrust grounds, though said final approval of the combination has not yet been issued by either department. The most recent proposed airline merger, between JetBlue and Spirit, was blocked by the DOJ.

Be careful what you eat or drink on your next flight — passengers unfamiliar with the way their bodies handle certain foods and beverages could be in for a rough landing, a pro warns.

First Officer Paul Janowicz, experienced Delta pilot, explained that for those trying to keep things at a comfortable cruising altitude, the number one thing to be careful of is booze.

There are lots of foods that can cause discomfort on flights.

“Alcohol can dehydrate you and make you feel groggy and tired after the flight,” he told Well + Good .

“Due to the pressure changes in the cabin, a person will get intoxicated faster drinking in-flight than on the ground.”

Airline experts advise not drinking on flights.

The warning comes as some airline industry honchos are floating the idea of capping alcohol purchases in airports — but more for peacekeeping reasons, as unruly behavior has made the skies a lot less friendly in recent years.

Coffee, used by flight attendants to mask bad smells on an aircraft , is another item landing on Janowicz’s no-fly list.

“While it may be nice for those early morning flights, the caffeine in coffee will dehydrate you in an already dehydrating cabin environment,” he added.

Flight crews have warned again and again that the tank sources for plane water used in coffee and tea can be surprisingly gross .

Carbonated beverages are also worth passing on due to gas and bloating, according to the first officer.

Greasy foods can cause stomach issues on planes.

“Especially if drinking while the plane is climbing or descending with the pressure changes that occur in the cabin.”

Spicy food is another one that can cause chaos at 30,000 feet, he said, adding that this is applied to what’s consumed before boarding as well.

“Generally our menus onboard are very mild, but I would not pack any snacks that might have spice involved as it may cause stomach discomfort in-flight.”

And, last but not least, fried food’s “higher sodium” leads to a double whammy of both gas and bloating along with dehydration.

While those may be the pilot’s recommendations, customers have spoken up as well regarding what they wish security would flag as a travel faux pas.

A recent survey found 92% of flyers expressed ire against several foods — one planeload nearly went into revolt after one traveler decided to eat a rack of ribs en route .

Other odiferous food notorious for annoying your stomach — and other passengers — includes boiled eggs and tinned fish.

Although not brought on for consumption, fish stowed away in a passenger’s carry-on caused maggots to fall from the stow-away bins onto people in nearby rows last winter.

Alaska Airlines clears last regulatory hurdle to finalize merger with Hawaiian Airlines

The US Department of Transportation (DOT) has given Alaska Airlines permission to close on its $1.9 billion acquisition of Hawaiian Airlines, after the carriers agreed to maintain key Hawaiʻi routes and adopt consumer protections. This exemption allows the carriers, which are respectively the fifth and 10th largest domestic airlines, to finalize their merger while maintaining separate operations until DOT rules on their transfer application.

DOT said the carriers have agreed to protect frequent flyer miles, to ensure HawaiianMiles and Alaska Mileage Plan miles retain their value at a 1:1 ratio after the merger. In addition, Alaska and Hawaiian will need to maintain “robust” levels of service for critical Hawaiian inter-island passenger and cargo service and the continental United States, ensure competitive access to Honolulu airport, offer fee-free family seating, lower costs for service members and their families, and provide alternative compensation for delays and cancellations, according to the agreement.

Alaska Airlines said on Tuesday that these commitments align with the plans it had last year when it signed the transaction and “do not impact the synergies of the deal, which will enhance competition and expand choice for consumers.”

Until DOT completes its review of the transfer application, Alaska and Hawaiian must operate independently. If the transfer is approved, these protections will be in place for six years.

“We look forward to formally welcoming Hawaiian Airlines’ guests and employees into Alaska Air Group,” said Alaska Air Group CEO Ben Minicucci. “We sincerely appreciate the exceptional care and service that employees of both companies have continued to show for one another and our guests throughout this process, and the support of both airlines’ labor unions, as we proceed to realize the vision for this combination and build a stronger future together.”

Biden administration OKs Alaska Airlines purchase of Hawaiian Air but with conditions

The Biden administration is letting Alaska Airlines complete its $1 billion purchase of Hawaiian Airlines after the carriers agreed to certain conditions, including maintaining current service on routes between Hawaii and the mainland U.S. where they don’t have much competition.

Transportation Department officials said Tuesday that no obstacles remain to the airlines closing the deal and beginning to merge, although some final approvals were still pending.

Alaska Airlines said it expected to close the deal “in the coming days.”

Alaska’s stock closed down 1%, while shares in Hawaiian Holdings rose 4% to $18, the price per share that Alaska agreed to pay for its smaller rival.

The decision to clear the way for the airlines to merge stands in contrast to the administration’s adamant opposition to previous airline deals. The Justice Department successfully sued to block JetBlue from buying Spirit Airlines for $3.8 billion, and it went to court to kill a partnership between JetBlue and American Airlines.

The Justice Department could still challenge the Alaska-Hawaiian deal, but that appeared unlikely.

The Transportation Department, which also must approve airline mergers, said Alaska and Hawaiian promised to meet certain conditions for six years.

Those include preserving subsidized flights to smaller communities in Alaska and Hawaii, and maintaining current levels of service between Hawaii and the mainland where no more than one other airline currently flies the same route. The Transportation Department could drop the latter requirement if the flying becomes unprofitable.

Alaska and Hawaiian also agreed to some consumer protections, including maintaining the value of frequent-flyer rewards as they combine their loyalty programs, guaranteeing families can sit together without paying extra fees, and offering lower costs to military families.

Transportation Secretary Pete Buttigieg said the airlines also promised to compensate passengers for cancellations and significant delays that are the carriers’ fault.

Seattle-based Alaska Airlines said in a statement that the promises are similar to its plans all along and would not affect “the synergies of the deal, which will enhance competition and expand choice for consumers.”

The Transportation Department said it gave Alaska and Hawaiian an exemption to combine ownership — to merge. The department is still reviewing the airlines’ request to fly international routes under one operating certificate, which is likely only a formality.

The airlines announced the deal in December, when they valued it at $1.9 billion including Hawaiian debt that Alaska will take over. Alaska vowed to retain the Hawaiian brand.

The deal will solidify Alaska Air Group’s position as the fifth-largest U.S. airline company by revenue and expand its international profile with Hawaiian’s extensive flying between the island state and Asia.

Open seating no more? Southwest CEO says airline is weighing cabin changes

Southwest Airlines  is considering changes to its single-class, open-seating cabins to drive up revenue, CEO Bob Jordan told CNBC on Thursday, a shift that could be among the largest in the airline’s history.

“We’re looking into new initiatives, things like the way we seat and board our aircraft,” Jordan said in an interview after the carrier’s  disappointing first-quarter report.

Southwest’s all- Boeing  737 fleet has a single economy class cabin and no seating assignments, though it does offer earlier boarding for a fee so customers can snag their preferred seats. The airline has focused on keeping its product simple and user-friendly for years, aiming to keep its own costs and complexity to a minimum.

Meanwhile, rivals including  Delta  and  United  have touted high revenue growth for premium seating such as business class and  strong upsell rates .

Analysts have repeatedly asked Southwest about opportunities for premium seating or additional fees. (The airline doesn’t charge travelers for their first two checked bags.)

Most U.S. airlines charge travelers to choose many of its seats in advance, even those that don’t come with extra legroom. Eight U.S. carriers —  Alaska ,  Allegiant ,  American , Delta,  Frontier ,  JetBlue ,  Spirit  and United — together brought in $4.2 billion from seating fees in their domestic networks in 2022, according to Jay Sorensen, an airline ancillary revenue expert at IdeaWorksCompany.

Jordan said no decisions have been made on what kind of changes Southwest will ultimately make, but he said studies have yielded “interesting” results.

“Customer preferences do change over time,” Jordan said.

While details were scarce during Southwest’s earnings call, when asked whether Southwest would consider a separated cabin on its planes, Ryan Green, the carrier’s chief commercial officer said: “Curtains and things like that are a bit far afield from what Southwest Airlines is.”

Green added that the carrier is not considering charging for checked bags because “people choose Southwest Airlines because we don’t have bag fees.”

With airspace bans in place and geopolitical disruption ongoing, it would be easy to think Russia was somewhat cut off from the rest of the world. But that’s not entirely the case. Although numerous foreign airlines have pulled out of services to Russian cities, there are still almost 3,500 flights per month arriving from international carriers.

In all, 30 overseas airlines still fly into Russia, offering 620,000 seats across almost 940 million available seat miles. We take a look at the biggest and most prolific international airlines still flying to Russia.

Turkish Airlines flies the most

Of the 30 non-Russian airlines still flying into the country, the carrier with the most flights is Turkish Airlines . In June, the airline is scheduled as flying a total of 1,395 services to the country, offering over a quarter of a million sets and 373 million seat miles to Russians. Its top destinations include Moscow-Vnukovo (VKO) at 676 flights, St Petersburg (LED) with 227 flights, and Moscow Domodedovo with 209.

Also flying significant capacity into Russia, although around a third of what Turkish is flying, are Uzbekistan Airways (420 flights) and Belavia (392). Uzbekistan Airways offers almost double the seats, however, with a capacity of almost 83,000 compared to Belavia’s 48,000. This is down to its strong use of widebody Dreamliners and Boeing 767s alongside its Boeing 757 and A320 family aircraft. Belavia flies the 737 family and E-Jets.

Also operating over 100 flights in June were the UAE’s flydubai , Kyrgyzstan’s Avia Traffic Company, Turkey’s Pegasus, and Tajikistan’s Somon Air.

Turkey and the UAE offer the most flight options

Alongside Turkish Airlines, low-cost Pegasus further bolsters connectivity to Russia from the country. In all, this makes up a total of 1,541 one-way flights between Turkey and Russia, with almost 300,000 seats this June.

Also conspicuous in its dedication to Russian connectivity is the United Arab Emirates (UAE). Four airlines continue to fly to Russia from the Gulf State – flydubai, Emirates , Etihad and Air Arabia. Although flydubai offers the most, Emirates still serves the country with 84 flights per month, while Air Arabia and Etihad both fly around 30.

Some might say these airlines should reconsider their operations, given the public image of flying into Russia right now. Speaking to Simple Flying on the sidelines of the IATA AGM this week, Sir Tim Clark, president of Emirates, defended his position, saying,

“As I've said, time and time again, we are operating [to Russia] because we haven’t been told not to operate … as long as the government that controls us says it's okay, then we will continue to do so.”

All four airlines intend to continue flying to Russia for the rest of the summer season. Air Arabia’s schedules currently forecast doubling flight capacity by September, while the other three are planning to maintain similar levels of operations.

One Middle Eastern airline that has pulled out of Russia, however, is European low-cost Wizz Air’s UAE subsidiary. Wizz Air Abu Dhabi suspended flights to Russia after the invasion of Ukraine in February along with its parent company. The group further announced a full suspension of flights to Russia for the rest of the summer .

Misbehaving airline passengers are paying a steep price.

Data shared by the Federal Aviation Administration showed that it has fined "unruly passengers" over $20.9 million since the COVID-19 pandemic began in 2020.

Air travel in the United States came to a near-total halt in 2020 after the Centers for Disease Control and Prevention confirmed the first COVID-19 case that January. That year, the FAA levied $0.6 million in fines against "unruly passengers."

That number skyrocketed in 2021 to $5 million. At that time, COVID-19 vaccines had become more accessible, and border restrictions began to ease , meaning more people were returning to air travel .

The FAA's fines peaked in 2022 at $8.4 million. That year, the agency said it levied its largest fines against two passengers for separate incidents in 2021. The proposed fines were $81,950 and $77,272, respectively.

The FAA fined passengers $7.5 million in 2023, a slight dip but still significantly higher than pre-pandemic.

"Unruly behavior is dangerous to everyone on board and in the skies because of the inconvenience, the threat of health, safety and security, and possible operational disruption of an aircraft in flight," the FAA said in a statement.

The agency said the unruly passenger rate declined by over 65% between 2021 — when the FAA recorded almost 6,000 cases — and 2023, when it recorded about 2,000. That's still higher than pre-pandemic numbers in 2017, 2018, and 2019.

The FAA said it had received almost 900 "unruly passenger" reports as of September 8 this year but didn't have data on the number of fines it has issued so far.

In August, the agency said it referred over 300 of the "most serious cases" since 2021 to the FBI. Those cases involved everything from passengers attempting to breach the flight deck to physically assaulting other travelers.

"Unruly passengers are a threat to the safety of everyone on board an aircraft. The FAA's zero-tolerance policy is working to reduce this threat and to signal that unruly behavior is not tolerated on any flight," the statement read.

Aviation security expert Jeffrey Price told BI that travel-related stress, like delayed or canceled flights, can cause passengers to act out.

"Increased stress pretty much always results in a shorter fuse, whether that's on a plane or on the road," Price told BI, adding that some travelers are behaving "more entitled" post-pandemic.
